Impeachment and Expulsion

Section
1:
Notification:
a)
Any Executive Officer may be impeached or removed directly
and immediately for failure to perform his or her prescribed duties
properly and in good faith after being notified about the
impeachment or removal in writing at least one week prior to the
meeting at which the impeachment will be considered or the date in
which the expulsion will occur.
Section
2:
Immediate Expulsion:
a)
An Executive Officer not fulfilling his/her requirements as
stated in the bylaws will be removed immediately from their position
by a majority vote of the remaining Executive Officers, without an
impeachment trial.
Section
3:
Direct Expulsion Vacancies:
a)
An election will take place immediately following the direct
expulsion of the Executive Officer in order to promptly fill the
vacant position on the Executive Board.
Section
4:
Impeachment Petitions:
a)
If there are no grounds for immediate expulsion as decided by
a majority vote of the Executive Officers, impeachment charges may
be brought against an Executive Officer(s) by either a petition,
which includes the signatures of one-third of the active club
members, or by a petition signed by two-thirds of the elected
Executive Officers. Such
a petition must be filed with the President and Secretary.
Section
5:
Trial Meetings:
a)
The Executive board shall impeach a member with a two-thirds
vote of all
active members. If an
impeachment occurs, the Executive Officers shall pick a date and
schedule a “Trial Meeting” in which all Active Members shall be
notified. At the
“Trial Meeting,” each side shall present evidence and arguments,
and a vote will occur. A
two-thirds conviction vote of all Active Members present at this
“Trial Meeting,” is necessary for an impeachment conviction.
The accused may not vote.
A majority of active members must be present at the “Trial
Meeting,” in order for an impeachment conviction to occur, not
counting the accused.
Section
6:
Conviction:
a)
An impeachment conviction(s) shall result in the immediate
removal of the accused Executive Officer from his/her elected
position.
Section
7:
Trial Meeting Notification:
a)
The Active Members of the club shall be notified of a
“Trial Meeting” seven days prior to the “Trial Meeting.” The accused Executive Officer shall receive advanced written
notice at least ten days prior to the “Trial Meeting.”
Section
8:
Grounds for Impeachment:
a)
Grounds for impeachment include malfeasance, misfeasance in
office, action contrary to the club’s constitution, action
detrimental to the club, and conduct unworthy of an officer.
Section
9:
Impeachment Vacancies:
a)
An election will take place immediately following the
impeachment conviction of the Executive Officer in order to promptly
fill the vacant position on the Executive Board.
Section
10:
Member Expulsion:
a)
The procedure for expulsion of a member(s) of the club shall
be the same that of impeachment.
Section
11:
Member Expulsion Grounds:
a)
Grounds for expulsion of a member(s) shall be statements or
actions detrimental to the club and conduct unworthy of a member of
the club.
